These Terms of Service ("Terms") govern your use of brightpointsolutions.ai (the "Site"), operated by BrightPoint Solutions ("BrightPoint," "we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. About BrightPoint
BrightPoint Solutions is developing AI-powered electrical estimating software. The Site currently exists to provide information about the product and to collect waitlist signups ahead of general availability. The product itself is not yet generally available.
2. Use of the Site
You may use the Site for lawful, personal, or business informational purposes. You agree not to:
● Use the Site in any way that violates applicable law
● Attempt to gain unauthorized access to any part of the Site or its underlying systems
● Interfere with or disrupt the Site, its servers, or networks
● Use automated means (bots, scrapers, crawlers) to access the Site, except for standard search engine indexing
● Submit false, misleading, or fraudulent information through any form on the Site
● Use the Site to send spam, harass others, or distribute malicious code
3. Waitlist and Communications
By joining our waitlist, you authorize BrightPoint to contact you at the email address you provide about the product, early-access opportunities, and related updates. You can unsubscribe at any time. Submitting your information to the waitlist does not guarantee access to the product or any specific timeline for access.
4. Intellectual Property
All content on the Site — including text, graphics, logos, images, the BrightPoint name and lightning bolt mark, video, and software — is owned by BrightPoint or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any Site content without our prior written permission, except as permitted by applicable law.
5. Disclaimers
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. BRIGHTPOINT DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Any product features described on the Site reflect the product as currently planned or in development, and may change. Information on the Site is provided for general informational purposes and does not constitute professional, legal, financial, or technical advice.
6. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BRIGHTPOINT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS (US $100.00).

You agree to indemnify and hold harmless BrightPoint and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or your violation of these Terms.

11. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising out of or related to these Terms or the Site shall be brought exclusively in the state or federal courts located in Orange County, California, and you consent to the jurisdiction of those courts.
12. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and BrightPoint regarding the Site and supersede any prior agreements.
